This can ask that you pay back what\u2019s owed in full straight away. Once the CCJ has been issued, it\u2019s recorded publicly on the <a href=\"https:\/\/rojof.org.uk\/\" target=\"_blank\" rel=\"noopener\"><strong>Register of Judgments, Orders and Fines<\/strong><\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"how-long-does-a-ccj-stay-on-your-credit-file\"><span class=\"ez-toc-section\" id=\"how_long_does_a_ccj_stay_on_your_credit_file\"><\/span><strong>How Long Does a CCJ Stay on Your Credit File?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong>A CCJ will stay on your credit file for 6 years from the date the judgement was passed<\/strong>. While the CCJ is on your credit file you\u2019ll find it hard to get credit. This is because lenders will see it when they do a credit check.<\/p>\n\n\n\n<p>It suggests to them that there\u2019s a greater risk you won\u2019t pay them back.<\/p>\n\n\n\n<p><strong>The CCJ will remain on the public records for 6 years too.<\/strong> This is the Registry of Judgments, Orders and Fines. Anyone can look at the register if they pay a small fee. But not anyone can see your credit file. Only people or companies with a legitimate reason can look at your credit file.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"what-should-i-do-if-i-have-received-a-ccj\"><span class=\"ez-toc-section\" id=\"what_should_i_do_if_i_have_received_a_ccj\"><\/span><strong>What Should I Do if I Have Received a CCJ?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong>If you\u2019ve received a County Court Judgement, it\u2019s important you don\u2019t ignore it.<\/strong> There\u2019s a process that lenders have to follow before a judgement is made against you. The table below shows the steps they must take and what that means for you.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table><tbody><tr><td class=\"has-text-align-center\" data-align=\"center\"><strong>The steps that take place with a CCJ<\/strong><\/td><td class=\"has-text-align-center\" data-align=\"center\"><strong>What this means for you<\/strong><\/td><\/tr><tr><td class=\"has-text-align-center\" data-align=\"center\">The lender will send you a letter with a claim form.<\/td><td class=\"has-text-align-center\" data-align=\"center\">This is when the lender will try to come to an agreement with you on how you\u2019re going to repay your debt. At this point you\u2019re better off coming to an agreement with the lender to avoid getting the CCJ. <strong>You\u2019ll have 30 days to respond to this request from the lender.<\/strong><\/td><\/tr><tr><td class=\"has-text-align-center\" data-align=\"center\">If you don\u2019t respond to the claim form, the lender can go to court to recover their money.<\/td><td class=\"has-text-align-center\" data-align=\"center\">The court will send you a county court claim form to complete. You\u2019ll have 14 days to respond to this and send back the forms. Failure to respond will mean the court will decide how you pay back the debt without knowing your situation.<\/td><\/tr><tr><td class=\"has-text-align-center\" data-align=\"center\">The CCJ is decided in court.<\/td><td class=\"has-text-align-center\" data-align=\"center\">The court will decide how you\u2019re going to pay back the debt. This will be either in full or in monthly instalments. The decision on how it\u2019s paid back will depend on whether you provided any information. If you go to court, you\u2019ll be able tell them how you want to pay it back.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"how-can-i-remove-a-ccj-from-my-credit-file\"><span class=\"ez-toc-section\" id=\"how_can_i_remove_a_ccj_from_my_credit_file\"><\/span><strong>How Can I Remove a CCJ from My Credit File?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong>If you disagree with the lender\u2019s claims, you can apply to the court to have the CCJ cancelled<\/strong>. This is known as having it set aside. When you do this, it stops the CCJ from being registered against you. <strong>It can be done for the following reasons<\/strong>:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>There were errors in the information the lender provided.<\/li><li>You paid the outstanding amount in full before the court date.<\/li><li>You paid the outstanding debt in full within 30 days after the court judgement date.<\/li><\/ul>\n\n\n\n<p>If you successfully have the CCJ set aside, it\u2019ll be removed from your credit file and from the public register. If you can\u2019t have the CCJ set aside it will be removed automatically when the six years is up.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"what-happens-if-i-ignore-a-ccj\"><span class=\"ez-toc-section\" id=\"what_happens_if_i_ignore_a_ccj\"><\/span><strong>What Happens if I Ignore a CCJ?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>If you ignore a CCJ, the debt won\u2019t go away, you\u2019ll still have to repay it. <strong>The lender can take further action to recover their money<\/strong>. This could include the following action.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>They could send <strong><a href=\"https:\/\/www.gov.uk\/your-rights-bailiffs\" target=\"_blank\" rel=\"noreferrer noopener\">bailiffs<\/a><\/strong> round to your home. Bailiffs can take away items you own to the value of the debt.<\/li><li>If you own your home, they could apply for a&nbsp;<strong><a href=\"https:\/\/www.stepchange.org\/debt-info\/debt-collection\/charging-orders-and-my-home.aspx\" target=\"_blank\" rel=\"noreferrer noopener\">charging order<\/a><\/strong>&nbsp;on your property. This means the debt is secured against your property. If you don\u2019t pay back the debt, the lender could repossess your home. &nbsp;<\/li><li>The lender could apply to have money taken directly from your wages. This is known as an&nbsp;<strong><a href=\"https:\/\/www.stepchange.org\/debt-info\/debt-collection\/attachment-of-earnings.aspx\" target=\"_blank\" rel=\"noreferrer noopener\">attachment of earnings order<\/a><\/strong>.<\/li><\/ul>\n\n\n\n<p>If you can\u2019t afford the repayments, you can ask the court to let you make payments you can afford. You would do this by completing the &#8216;<strong><a href=\"https:\/\/www.gov.uk\/government\/publications\/form-n245-application-for-suspension-of-a-warrant-and-or-variation-of-an-order\" target=\"_blank\" rel=\"noreferrer noopener\">N245 form<\/a><\/strong>&#8216;. Enter whatever you can afford on the form and the court will consider it.<\/p>\n\n\n\n<p>If you\u2019re struggling to repay a debt, then get help. There are organisations who can give you advice for free.
