Terms and Conditions of the Nintendo Wii Prize Draw

To participate in the prize draw to win the Nintendo Wii and other prizes, in addition to the terms and conditions of the website, you must also follow and abide by the below mentioned terms and conditions:

1. Definitions

1. "Participant" means an entrant who is eligible for the prize draw. To be eligible for the prize draw an entrant must

1. be a resident of UK,
2. be at least 18 years of age or above, and
3. have an active payday loan funded by Promoter which has not been repaid within 15 days of receiving such payday loan.
4. not have defaulted on any repayments during the term of such payday loan.
   

2. Participant must ensure that all the details submitted at the Promoter’s website are correct and complete in all respects. In order to be eligible to participate in the prize draw, it is a mandatory condition that Participant should have received the payday loan from Promoter before prize draw winner is announced. By participating in this prize draw, you acknowledge and you agree to be bound by any decisions made by Promoter, including any interpretations of these terms and conditions.
   
3. Residents of Northern Ireland are specifically are not allowed to take part in this prize draw.
   
4. "Promoter" means Lending Stream Ltd at Wisteria Cavendish House, 369 Burnt Oak Broadway, Edgware, Middlesex, HA8 5AW.
   
5. The "Promotional Period” shall commence on 20/10/09 at 12:00 BST/GMT and will end on 17/11/09 at 12:00 BST/GMT. Late entries will be disqualified from the draw.
   
   
   
1. Prize Draw:
   
1. 1 (one) grand prize (the "Grand Prize”) winner and 4 (four) consolation prize (the "Consolation Prize”) winners will be randomly picked from all eligible Participants on 19/11/09 at 12:00 GMT/BST.

2. The Grand Prize winner and the Consolation Prize winners (collectively the "Prize Draw Winner”) shall be notified by phone or email (as provided by the Participant) with in 14 days of the selection of the Prize Draw Winner. The Prize Draw Winner needs to confirm the postal address by contacting us at 084 4251 0530 within 7 working days of the notification. The Grand Prize and the Consolation Prize shall be delivered (subject to availability) to the postal address provided by the Prize Draw Winner. The Prize Draw Winner agrees that there might be a delay in posting the prize to the postal address, for reasons beyond the control of Promoter. The Prize Draw Winner disclaims all claims against Promoter, relating to delay in posting the prize.

3. If a Prize Draw Winner is unable to be contacted after a reasonable period or if any prize is unclaimed or declined within a reasonable period, the prize shall be deemed as unclaimed or unaccepted and a supplementary winner/s may be drawn at Promoter's discretion as the case may be.

4. The Grand Prize and the Consolation Prize is not transferable, exchangeable or redeemable for cash. Promoter reserves the right to replace the Grand Prize and the Consolation Prize with another of equivalent value without notice. Promoter accepts no responsibility for any variation in the Grand Prize and the Consolation Prize value.
   
5. Only a Prize Draw Winner and not any other person or agent, may claim a prize.
   
   

3. Winner Publicity
   
1. Participants accept that, if they win, the Promoter will have the right, without additional payment or permission, to use their name, age, town of residence and likeness for the purposes of announcing the winner of this competition and for related promotional purposes, in its sole discretion. Promoter may exhibit this material in any manner including in movies, on radio, on Internet, on television, in print media without any compensation or permission whatsoever.

4. Promoter will not be liable for any damage, loss or disappointment suffered by any person taking part or not being able to take part in this prize draw.
   
   
   
5. False and/or deceptive entries or acts shall render Participants’ entries ineligible. The Promoter reserves the right to verify the validity of entries at any time during or after the promotional period, and reserves the right to disqualify any Participant for tampering with the entry process or for submitting an entry that is not in accordance with these terms and conditions. Promoter reserves the right to oblige any potential winner to provide documentary proof of their identity and address as directed by the Promoter before such person may claim their prize.
   
   

6. The Promoter’s decision on all matters pertaining to this prize draw is final, binding and not open to question. No correspondence will be entered into except as otherwise stated in these terms and conditions.
   
   

7. Promoter makes no warranty, either express or implied, regarding the campaign website or any of its content, including but not limited to, merchantability or fitness for a particular purpose. Promoter does not warrant that the content and delivery of the website shall be free from errors, bugs or viruses, uninterrupted, or repairable if damaged or impaired. Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the internet or at any website, or any combination thereof, (including but not limited to) any injury or damage to participants’ or any other person’s computer related to or resulting from participation.
   
   

8.  All entries become the property of Promoter. The Promoter collects your personal details in order to conduct the promotion, and may pass that information to its related bodies corporate and agencies assisting with the promotion, either within or be outside the UK. If the information requested is not provided, you may not participate in this promotion. If you give your consent Promoter may contact you from time to time with information about special offers and products and services that may interest you, but you may unsubscribe later if you no longer wish to receive further marketing information.
