Terms and Conditions of the Customer Appreciation Day contest

To be eligible for free gift, in addition to the terms and conditions of the website, you must also follow and abide by the below mentioned terms and conditions:

1. Definitions

1. "Eligible Customer" means a customer who is eligible for the free gift. To be eligible for the free gift an Eligible Customer must

1. be a resident of UK;
2. be at least 18 years of age or above;
3. must have an active loan funded by the Promoter;
4. not have defaulted on any repayments during the term of such payday loan; and
5. be with in the first 100 customers to log in to the Existing Customer section of the Lending Stream Website using a unique username and password.
   

2. For the avoidance of any doubt, if you have defaulted on any of the repayments, You will automatically be disqualified from this promotion.
   
   
3. Eligible Customer must ensure that all the details submitted at the Promoter's website are correct and complete in all respects. In order to be eligible, it is a mandatory condition that Eligible Customer should have a payday loan from Promoter. If you have defaulted on any of the repayments, You will automatically be disqualified from this promotion. You acknowledge and you agree to be bound by any decisions made by Promoter, including any interpretations of these terms and conditions.
   
   
4. Residents of Northern Ireland are specifically are not allowed to take part in this promotion.
   
   
5. "Promoter" means Lending Stream Ltd at Wisteria Cavendish House, 369 Burnt Oak Broadway, Edgware, Middlesex, HA8 5AW.
   
   
6. The "Promotional Period” shall commence on 19/11/2009 at 07:00 BST/GMT and will end on 19/11/2009 at 23:59 BST/GMT. Late entries will be disqualified.
   
   
   
1. Free Gifts:
   
1. If the eligibility criteria defined in 1(a) above is met, first 100 Eligible Customers who log into their customer accounts, will be given one free gift each at random.
   
   
2. Computer will at random select free gift from available list of gifts for each Eligible Customer. Results will be final and not be open to dispute.
   
   
3. Free gift will be posted to Eligible Customer 15 days after the Promotional Period ends. Eligible Customer agrees that there might be a delay in posting the free gift to the postal address, for reasons beyond the control of Promoter.  A random free gift shall be delivered (subject to availability) to the postal address provided by the Eligible Customer. The Eligible Customer disclaims all claims against Promoter, relating to delay in posting the free gift.
   

4. If an Eligible Customer is unable to be contacted after a reasonable period or if any free gift is returned undelivered, the free gift shall be deemed as unclaimed or unaccepted. In such an event the Promoter shall give no replacement free gift.
   

5. Free gift is not transferable, exchangeable or redeemable for cash. Free gift is subject to availability. In the unlikely event that your gift is unavailable we reserve the right to replace it with one of equal or higher value. Promoter accepts no responsibility for any variation in the free gifts. Promoter shall not be liable to return or replace or refund any such free gift that does not meet or match expectations of the Eligible Customer.
   
   
6. Only an Eligible Customer and not any other person or agent, may claim a free gift.
   
   
7. Eligible Customers accept that, the Promoter will have the right, without additional payment or permission, to use their name, age, town of residence and likeness for the purposes of announcing the Eligible Customer of this competition and for related promotional purposes, in its sole discretion. Promoter may exhibit this material in any manner including in movies, on radio, on Internet, on television, in print media without any compensation or permission whatsoever.
   
   
8. The Website is presented on an "as is" basis. We make no representations or warranties of any kind whatsoever, express or implied, in connection with these terms or the Website, including but not limited to warranties of satisfactory quality, non-infringement or fitness for a particular purpose, except to the extent that such representations and warranties are not excludable by law. No responsibility is accepted by the Promoter for any damage or loss arising directly or indirectly out of free gifts, supplied or for any damage or loss arising by reason of any failure of free gifts to comply with the specification or with statutory requirements whether attributable to Promoter's negligence or otherwise save to the extent that exclusion of liability is prohibited by law.
   
   
10. We make all reasonable efforts to ensure that the information on our Website is accurate and up to date. However, you should always independently check any information before you rely on it. We do not represent or warrant that the information accessible via this Website is accurate, complete or current and we do not accept liability for any loss whatsoever arising from any inaccuracy or information that is out of date.

3. Promoter will not be liable for any damage, loss or disappointment suffered by any person taking part or not being able to be an Eligible Customer.
   
   
4. False and/or deceptive entries or acts shall render Eligible Customers' entries ineligible. The Promoter reserves the right to verify the validity of entries at any time during or after the Promotional Period, and reserves the right to disqualify any Eligible Customer for tampering with the entry process or for submitting an entry that is not in accordance with these terms and conditions. Promoter reserves the right to oblige any Eligible Customer to provide documentary proof of their identity and address as directed by the Promoter before such person may claim their free gift.
   

5. The Promoter's decision on all matters pertaining to this is final, binding and not open to question. No correspondence will be entered into except as otherwise stated in these terms and conditions.
   

6. Promoter makes no warranty, either express or implied, regarding the campaign website or any of its content, including but not limited to, merchantability or fitness for a particular purpose. Promoter does not warrant that the content and delivery of the website shall be free from errors, bugs or viruses, uninterrupted, or repairable if damaged or impaired. Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the internet or at any website, or any combination thereof, (including but not limited to) any injury or damage to Eligible Customers' or any other person's computer related to or resulting from participation.
   

7.  All entries become the property of Promoter. The Promoter collects your personal details in order to conduct the promotion, and may pass that information to its related bodies corporate and agencies assisting with the promotion, either within or be outside the UK. If the information requested is not provided, you may not participate in this promotion. If you give your consent Promoter may contact you from time to time with information about special offers and products and services that may interest you, but you may unsubscribe later if you no longer wish to receive further marketing information. 8.  Promoter reserves all rights to make amendments to the rules without prior notice and/or to cancel, postpone, stop or terminate the promotion in its sole discretion.
